Participation Waiver

In consideration of being allowed to participate in any way in the classes, events, tournaments, and/or activities of Detroit Kendo Dojo:

1. I recognize and understand that kendo is a full-contact martial art that involves physical contact and that my participation might result
in serious injury, including permanent disability or even death, and severe social and economic loss.
2. I recognize and understand that such risk may be due to not only my own actions, but also the action, inaction, or negligence of
others, the regulations of participation, or the conditions of the premises, or of any of the equipment used.
3. I recognize that there may be other risks that are not known to me or to others or not reasonably foreseeable at this time.
4. I acknowledge the contagious nature of infectious diseases including but not limited to COVID-19 and I accept the risk that my
participation in Detroit Kendo Dojo activities may expose me and/or my children to infection.
5. I agree to review and abide by any and all protective measures and guidelines put in place by Detroit Kendo Dojo.
6. I acknowledge that I am responsible for my own safety. If at any time I feel that I and/or my children are being exposed to an
unreasonable risk of harm from injury or infectious disease, I will remove myself and/or my children from participation.

7. I agree to inspect the facilities, equipment and pairings prior to participation for conditions that may pose dangers specific to my
physical and/or mental condition and abilities. I will immediately inform an instructor or event organizer if I believe that anything is
unsafe or beyond my capability and refuse to participate.
8. I agree to inspect my equipment, including but not limited to my shinai and bogu, before and during each practice and agree to keep
my equipment in good repair and safe working condition at all times.
9. I assume all of the foregoing risks and accept personal responsibility for any damages that may result from injury, permanent disability,
or death.
10. I enter kendo training and/or competition entirely of my own free will and understand the importance of following the rules of training
and competition.
11. I recognize that kendo involves vigorous physical activity and certify that I am in good physical condition, and have no disease, injury,
or other condition that would impair my physical or mental well-being during intense training and/or competition.
12. I grant permission in case of injury to have a doctor, nurse, athletic training or other emergency medical personnel provide me with
medical assistance or treatment for such injury.
13. I release, waive, discharge, and covenant not to sue Detroit Kendo Dojo/Detroit Kendo Corporation, its affiliated organizations and
governing bodies, its officers, instructors and personnel, other members of the organization, participants, supervisors, sensei,
shinpan, sponsoring organizations or their agents, and if applicable, owners and lessors/lessees of the premises (collectively, the
“released parties”) from any and all liability to the undersigned, his or her heirs, and next of kin for any and all claims of any type
whatsoever, demands, losses, and damages which may be sustained and suffered on account of injury, including death or damage to
property, caused or alleged to be caused in whole or in part by the negligence or wrongful conduct of the released parties.
14. I agree to defend, indemnify, and hold harmless the released parties against any claims arising out of the negligent or willful acts or
omissions by me, my guests, or any person accompanying me to any Detroit Kendo Dojo event.
15. I agree that this agreement shall be governed by Michigan law. The invalidity or unenforceability of any provision of this agreement
shall not affect the validity or enforceability of any other provision of this agreement, which shall remain in full force and effect.
I HAVE READ THE ABOVE WARNING, WAIVER, RELEASE, AND ASSUMPTION OF RISK. I FULLY UNDERSTAND ITS CONTENTS, AND
UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT. I HEREBY SIGN IT VOLUNTARILY WITHOUT ANY
INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND
UNCONDITIONAL RELEASE OF ALL LIABILITY.

I HAVE READ THE ABOVE WARNING, WAIVER, RELEASE, AND ASSUMPTION OF RISK. I FULLY UNDERSTAND ITS CONTENTS, AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT. I HEREBY SIGN IT VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY.
